Rental conditions EasyFiets

1. Applicability

1. These general terms and conditions apply to every customer of EasyFiets.
2. Renter pays the full rental amount upon receipt of the bicycle.
3. By accepting the bicycle, the renter agrees to these General Terms and Conditions.
4. The amounts mentioned include VAT.

2. The Rental Agreement

1. The bicycle is provided with a ring lock, a chain lock, and one key.
2. It is not allowed for the renter to have a duplicate key made.
3. In case the key is lost or damaged by the renter, the renter must pay EasyFiets the cost for a new key of €20.-.
4. When renting an electric bicycle, the renter must always be able to show a valid ID.
5. EasyFiets has the right to ask the renter for a deposit.

6. At the end of the rental period, EasyFiets has the right to retrieve the bicycle.

3. Use of the bicycle

1. The renter is allowed to take a test ride on a bicycle before using it.
2. The renter is required to take good care of the bicycle.
3. If the renter notices any defects in the bicycle, they must contact EasyFiets immediately to resolve the issue.
4. It is prohibited to have more than one person on the bicycle, except for tandems, cargo bikes, and child seats.

4. Duration of the Rental Agreement

1. The renter must return the bicycle to EasyFiets before the end of the rental period.
2. If the renter fails to return the bicycle on time, the Rental Agreement is automatically extended.

5. Theft or Loss

1. In case of theft or loss of the bicycle, the renter must contact EasyFiets as soon as possible.
2. The renter must pay a fixed amount to EasyFiets if the bicycle is stolen during the agreed rental period. The amounts are defined as follows:
   • City bike € 500
   • E-bike € 1000
   • Tandem € 500
   • Cargo bike € 300
   • E-cargo bike € 2600
   • Children’s bike € 200
3. If the renter cannot hand over the key to EasyFiets, a negligence surcharge will be added to the fine for the loss of the bicycle.
   • City bike € 150
   • E-bike € 500
   • Tandem € 250
   • Cargo bike € 150
   • E-cargo bike € 1300
   • Children’s bike € 100
4. If the bicycle is taken by a municipality due to illegal parking or parking for too long, the renter is responsible for retrieving the bicycle. The renter can have EasyFiets retrieve the bicycle for an additional fee of €36.

6. Theft Guarantee

1. If the renter has taken out a theft guarantee with EasyFiets, EasyFiets will not charge the costs as mentioned in article 5.2 for the theft of the bicycle.
2. If the renter does not hand over the official key, the conditions for theft or loss as stated in article 5 will apply. The theft guarantee will then not be applicable.

7. Damage

1. If the bicycle is broken or has a flat tire, EasyFiets will always do its best to help the renter as far as it is within our power.
2. If there is suspicion of damage caused by the renter, EasyFiets reserves the right to withhold the amount defined in article 5.2 for the bicycle.
3. If damage has occurred due to the (partial) fault of a third party, the renter must provide the contact details of this party. Additionally, the renter must submit a completed damage form, signed by both parties, to EasyFiets. This damage form can be found at www.easyfiets.nl/europeesschadeformulier. If no contact information is provided, EasyFiets will hold the renter liable for the damage.
4. EasyFiets is not liable for damage or loss of the renter’s belongings.

8. Termination of the Rental Agreement

1. EasyFiets has the right to terminate the Rental Agreement immediately in the following cases:
   • Reselling the rented bicycle to third parties by the renter.
   • Aggressive behavior of the renter towards EasyFiets employees.
   • Irresponsible, reckless, or improper use of the bicycle by the renter.
2. In case of termination of the rental contract for one of the above reasons, EasyFiets reserves the right to recover the incurred costs from the renter.

9. Changes or Cancellations – Less than 10 bicycles

11. Liability

1. The renter bears full legal liability for any damage caused to third parties.

12. Privacy and data

1. EasyFiets handles your personal data responsibly. You can read how we do this in our Privacy Statement. For questions or comments, you can contact us through the usual channels.

13. Dutch law

1. These general terms and conditions are governed by Dutch law.
2. In the event of any disputes between EasyFiets and the buyer, EasyFiets will determine the location of the competent court to hear the dispute.
